Acceptance of Terms

By downloading, installing, or using AirMD+, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

Product Description

AirMD+ is a hobby-grade, do-it-yourself (DIY) HVAC monitoring system consisting of a mobile application and optional hardware monitoring device.

Hardware Requirements

IMPORTANT: The AirMD+ hardware Device is a separate product and is required for full functionality of this App, including access to premium subscription features.

  • Hardware checkout is currently paused while production release qualification is completed
  • Secure App pairing requires compatible AirMD+ firmware and a matching App version. The version 1.4 nearby setup flow supports eligible DIY Devices without a printed QR label; it requires Bluetooth pairing and physical confirmation on the Device. Private QR/manual setup remains available for compatible provisioned Devices.
  • Premium features require a functioning AirMD+ Device

AirMD+ is designed for hobbyists, enthusiasts, and educational purposes. It is:

  • NOT a professional-grade HVAC diagnostic tool
  • NOT a replacement for professional HVAC inspection or maintenance
  • NOT certified or approved by any HVAC regulatory body
  • Intended for informational and educational purposes only

Disclaimer of Warranties

THE APP AND DEVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.

We do not warrant that temperature readings, efficiency assessments, or AI-generated insights are accurate or applicable to your system.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HATCHING POINT LLC SHALL NOT BE LIABLE FOR:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Property damage to your HVAC system, home, or any other property
  • Personal injury arising from installation, use, or malfunction
  • Economic losses including repair costs, replacement costs, or increased energy bills
  • Any damages arising from reliance on App data or recommendations

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US FOR THE APP, SUBSCRIPTION, OR DEVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Hardware Installation Risks

YOU ACKNOWLEDGE AND AGREE THAT:

  • Installation of the Device near HVAC equipment carries inherent risks
  • Improper installation may damage your HVAC system, void warranties, or create safety hazards
  • You are solely responsible for proper installation and use
  • We recommend consulting a licensed HVAC professional before installation

Assumption of Risk

By using AirMD+, you expressly acknowledge and assume all risks associated with self-installation of hardware, placement of sensors, reliance on temperature data, acting on AI-generated recommendations, and any modifications to your HVAC system based on App data.

Indemnification

You agree to indemnify, defend, and hold harmless Hatching Point LLC from any claims, damages, losses, liabilities, costs, and expenses arising from your use or misuse of the App or Device, your installation of hardware, violation of these Terms, or any damage to property or persons.

Subscription Terms

  • Premium features require an active subscription and compatible hardware
  • Subscriptions are billed through Apple's App Store
  • Payment is charged to your Apple ID at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Manage subscriptions in your Apple ID account settings
  • Refunds are subject to Apple's refund policies
  • We do not provide subscription refunds for Device malfunction, improper installation, or HVAC incompatibility

User Responsibilities

  • Use the App and Device only for lawful purposes
  • Do not rely solely on AirMD+ for HVAC maintenance decisions
  • Consult licensed HVAC professionals for repairs and maintenance
  • Follow all local building codes and regulations
  • Maintain your HVAC system according to manufacturer recommendations
  • Do not reverse engineer, decompile, or modify the App

Intellectual Property

All content, design, and functionality of AirMD+ are owned by Hatching Point LLC and protected by intellectual property laws.

Third-Party Services

The App may integrate with third-party services, including AI providers. Your use of those features is subject to the applicable third-party terms and privacy policies. We are not responsible for third-party service availability or accuracy.

Termination

We may terminate or suspend access for conduct that violates these Terms, harms other users or third parties, or is fraudulent or illegal.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Dispute Resolution

Disputes arising from these Terms or your use of AirMD+ shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual-property violations.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the app after changes constitutes acceptance of the new terms.
