Acceptance of Terms

By downloading, installing, or using Klinka, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the app.

Description of Service

Klinka is a wedding speech writing and practice application that uses artificial intelligence to help users create and rehearse personalized wedding speeches. The app provides speech generation, practice recording, transcription, and delivery coaching features.

Subscription Terms

  • Klinka offers in-app purchases including Klinka Pro subscription plans that provide access to premium features.
  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel subscriptions in your Apple ID account settings.
  • No refunds will be provided for partial subscription periods.
  • Free trial eligibility is determined by Apple and is limited to one trial per Apple ID.

User Responsibilities

You agree to:

  • Provide accurate information when creating speech content.
  • Use the app for personal, non-commercial purposes only.
  • Not attempt to reverse engineer, hack, or disrupt the service.
  • Not use the app to generate harmful, illegal, defamatory, or inappropriate content.
  • Respect the privacy and dignity of individuals mentioned in your speeches.
  • Review and edit AI-generated content before using it in public settings.

AI-Generated Content

  • Speech outlines and suggestions are generated using artificial intelligence and should be reviewed and customized by you.
  • AI-generated content is provided as a starting point and creative assistance tool.
  • You are solely responsible for the final content of any speech you deliver.
  • We do not guarantee the accuracy, appropriateness, or quality of AI-generated content.

Audio Recording and Practice Features

  • Audio recordings made in Practice Mode are stored locally on your device.
  • Recordings are temporarily sent to OpenAI's Whisper API for transcription and analysis.
  • You are responsible for managing and deleting your audio recordings.
  • Coaching feedback is generated by AI and should be used as guidance, not absolute instruction.

Intellectual Property

  • All app design, functionality, and original content are owned by Hatching Point LLC and protected by copyright and intellectual property laws.
  • You retain ownership of the personal content and information you provide to the app.
  • Speech content you create using the app is yours to use as you wish.
  • You grant us a limited license to process your content solely for the purpose of providing the app's services.

Disclaimer of Warranties

Klinka is provided "as is" without warranties of any kind. We do not guarantee that:

  • The service will be uninterrupted or error-free.
  • AI-generated content will be suitable for your specific situation or audience.
  • The app will meet your specific requirements or expectations.
  • Audio transcription and analysis will be completely accurate.
  • Following the app's coaching suggestions will guarantee successful speech delivery.

Limitation of Liability

To the maximum extent permitted by law, Hatching Point LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Klinka, including but not limited to:

  • Embarrassment or negative reactions to speech content
  • Technical issues during speech preparation or practice
  • Loss of data or audio recordings
  • Reliance on AI-generated content or coaching suggestions

Third-Party Services

Klinka uses third-party services including OpenAI for AI features. Your use of these features is also subject to the respective third-party terms and policies. We are not responsible for the performance or policies of third-party services.

Termination

We reserve the right to suspend or terminate your access to Klinka at any time for violation of these terms or for any other reason at our discretion.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the app after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of the United States and the state in which Hatching Point LLC is registered, without regard to conflict of law provisions.
