1. Acceptance of Terms
By using Record+Transcribe, you agree to these Terms. We may modify Terms anytime; continued use constitutes acceptance.
2. Eligibility
You must be 13+ years old (16+ in EU/EEA) to use Record+Transcribe. If you are under 18, you must have parental permission.
3. Description of Service
Record+Transcribe is a voice recording and transcription app with AI-powered summaries. Features include:
- Voice recording with pause/resume functionality
- Real-time live transcription
- AI-generated intelligent summaries
- Smart auto-generated titles
- Transcript export and sharing
- Organized conversation history
Record+Transcribe is NOT a professional transcription service and may contain errors.
4. IMPORTANT DISCLAIMER
THE SERVICE IS FOR PERSONAL AND INFORMATIONAL PURPOSES ONLY.
Record+Transcribe is NOT a substitute for professional transcription services, legal documentation, medical records, or any official record-keeping. AI-generated summaries are automated pattern recognition, NOT guaranteed to be accurate or complete.
- Transcriptions may contain errors, omissions, or inaccuracies
- Do not rely on transcriptions for legal, medical, or critical purposes
- Always verify important information from original sources
- AI summaries may miss context or misinterpret content
We make no representations or warranties about the accuracy, reliability, or completeness of any transcription or AI-generated content. You should not act on transcribed content without independent verification.
5. Recording Consent
You are solely responsible for:
- Obtaining consent from all parties before recording conversations
- Complying with all applicable local, state, and federal recording laws
- Understanding that many jurisdictions require all-party consent for recordings
- Not recording in locations where recording is prohibited
HatchingPoint is not liable for any illegal recordings made using this app.
6. Subscription Terms
- Free tier: 60 minutes of transcription per month
- Pro tier: Unlimited transcription time
- AI summaries included for all users
- Auto-renewal unless cancelled 24+ hours before period ends
- Payments via Apple App Store
- Cancel anytime in Apple ID settings
- No refunds except as required by law/Apple
- Prices may change with notice
7. User Conduct
You agree to:
- Use for lawful purposes only
- Obtain consent before recording others
- Maintain device security
- Accept responsibility for your recordings
You agree NOT to:
- Record without proper consent
- Record confidential or privileged communications illegally
- Reverse engineer the Service
- Attempt unauthorized access
- Transmit harmful content
- Interfere with Service operation
- Sublicense or sell access rights
8. Intellectual Property
The Service is owned by HatchingPoint and protected by intellectual property laws. Your recordings and transcripts remain yours; you grant us a license to process them for Service delivery.
9. DISCLAIMER OF WARRANTIES
SERVICE PROVIDED "AS IS" WITHOUT WARRANTIES.
We disclaim:
- Implied warranties of merchantability/fitness
- Non-infringement warranties
- Warranties of uninterrupted/error-free service
- Warranties about transcription accuracy
- Warranties about AI summary accuracy
Use at your own risk.
10. LIMITATION OF LIABILITY
HATCHINGPOINT NOT LIABLE FOR:
- Indirect, incidental, special, consequential, punitive damages
- Loss of profits, revenue, data, or recordings
- Damages from use/inability to use Service
- Damages from transcription errors or inaccuracies
- Damages from reliance on AI-generated content
- Damages from illegal recordings you make
- Third-party service issues (OpenAI, Apple)
MAXIMUM LIABILITY: Greater of $100 or 12 months of fees paid.
11. Indemnification
You indemnify HatchingPoint against claims arising from your use of the Service, recordings you make, violations of these terms, or reliance on transcriptions or AI content.
12. DISPUTE RESOLUTION & ARBITRATION
Disputes resolved through binding individual arbitration (AAA rules), not court.
CLASS ACTION WAIVER: You waive the right to participate in class actions.
Opt-out: Email support@hatchingpoint.com within 30 days of first use.
13. Governing Law
Delaware law governs. Non-arbitration actions shall be brought in Delaware courts.
14. Termination
We may terminate access anytime. Upon termination: access ceases, prior fees due, survival clauses remain in effect. Your local data remains on your device.
15. Third-Party Services
OpenAI (for AI summaries) and Apple (for speech recognition and payments) integrations are subject to their respective terms. We're not responsible for third-party service availability or performance.
16. Severability
Invalid provisions will be struck; the remainder remains enforceable.
17. Entire Agreement
These Terms + our Privacy Policy constitute the entire agreement.
