Agreement to Terms

By accessing or using the Synara mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Hatching Point LLC ("Company," "we," "our," or "us").

Description of Service

Synara is a relationship intelligence application that provides:

• Numerology-based archetype analysis
• Relationship insights and guidance
• Personalized communication strategies
• AI-powered relationship advice (premium feature)
• Profile management and tracking

The App uses birth date information to generate personality archetypes and relationship compatibility insights based on numerological principles.

Eligibility

You must be at least 13 years old to use Synara. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

If you are under 18, you must have permission from a parent or legal guardian to use the App.

Account and Registration

Account Creation

• You may be required to create an account to access certain features
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate, current, and complete information
• You are responsible for all activities that occur under your account

Account Security

• Notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage from unauthorized account access
• You may not share your account with others

Acceptable Use

You Agree To:

• Use the App for lawful purposes only
• Provide accurate information when analyzing people
• Respect the privacy of others
• Use insights responsibly and ethically
• Comply with all applicable laws and regulations

You Agree NOT To:

• Use the App to harass, stalk, or harm others
• Share or distribute content from the App without permission
• Attempt to reverse engineer, decompile, or hack the App
• Use automated systems (bots, scrapers) to access the App
• Violate any intellectual property rights
• Impersonate others or misrepresent your identity
• Upload malicious code or viruses
• Use the App for any illegal or unauthorized purpose
• Manipulate or abuse the free tier limits

Subscriptions and Payments

Free Tier

• Limited to 3 lifetime person analyses
• No AI chat access
• Basic archetype insights

Premium Subscription

• Unlimited person analyses
• AI relationship assistant (50 calls per day)
• Full access to all features
• Billed monthly or annually through Apple App Store

Payment Terms

• All payments are processed through Apple's App Store
• Subscriptions automatically renew unless canceled 24 hours before the end of the current period
• Prices are subject to change with notice
• Refunds are handled according to Apple's refund policy
• You are responsible for any applicable taxes

Cancellation

• You may cancel your subscription at any time through your Apple App Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Access to premium features ends when subscription expires

Intellectual Property Rights

Our Rights

The App and all content, including text, graphics, logos, images, software, archetype descriptions, user interface design, algorithms, and methodologies are owned by Hatching Point LLC and protected by copyright, trademark, and other intellectual property laws.

Your Rights

• You retain ownership of any personal information you provide
• You grant us a license to use your data to provide the App services
• We may use anonymized, aggregated data for analytics and improvement

Restrictions

• You may not copy, modify, or distribute App content without permission
• You may not use our trademarks or branding without authorization
• You may not create derivative works based on the App
• You may not remove copyright or proprietary notices

AI-Generated Content

OpenAI Integration

• AI chat features use OpenAI's GPT models
• AI responses are generated based on archetype data and your questions
• AI responses are for informational and entertainment purposes only

Limitations

• AI responses may not always be accurate or appropriate
• We do not guarantee the quality or reliability of AI-generated advice
• You should not rely solely on AI advice for important decisions
• AI responses do not constitute professional advice (legal, medical, psychological, etc.)

The App does NOT provide professional relationship counseling, psychological or psychiatric advice, medical advice, legal advice, or financial advice. Accuracy of Information

• Results are for entertainment and self-reflection purposes
• We do not guarantee the accuracy, completeness, or usefulness of any information
• Individual results may vary

No Guarantees

We do not guarantee that the App will meet your specific requirements, be uninterrupted, timely, secure, or error-free, produce any particular results, or that any defects will be corrected.

Use at Your Own Risk

You acknowledge that you use the App at your own risk, relationship decisions are your own responsibility, and we are not responsible for outcomes of actions taken based on App insights.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS.

We are not liable for damages resulting from use or inability to use the App, unauthorized access to your data, errors or omissions in content, actions taken based on App insights, or relationship outcomes or decisions.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Hatching Point LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, your violation of any third-party rights, or your misuse of App insights or information.

Privacy

Your use of the App is also governed by our Privacy Policy, available at hatchingpoint.com/synara/privacypolicy. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

Modifications to the App

We reserve the right to modify or discontinue the App at any time, change features, functionality, or pricing, update archetype descriptions or methodologies, and impose limits on certain features. We will provide reasonable notice of material changes when possible.

Modifications to Terms

We may update these Terms from time to time. Changes will be effective when posted. Your continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of material changes by updating the "Last Updated" date, posting a notice in the App, and sending an email (if applicable).

Termination

By You: You may stop using the App at any time by deleting it from your device.

By Us: We may suspend or terminate your access if you violate these Terms, engage in fraudulent or illegal activity, we are required to do so by law, or we discontinue the App.

Upon termination: Your right to use the App immediately ceases, we may delete your account and data, subscription fees are non-refundable, and provisions that should survive termination will remain in effect.

Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Arbitration Agreement: Any dispute arising from these Terms or the App shall be resolved through binding arbitration, except for small claims court disputes (under $10,000), intellectual property disputes, and injunctive relief requests.

Arbitration Rules: Administered by the American Arbitration Association (AAA) under AAA's Consumer Arbitration Rules. Location: Delaware or your home state. Costs: Each party bears their own costs unless otherwise awarded.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action, consolidated action, or representative action.

Opt-Out: You may opt out of arbitration by sending written notice to support@hatchingpoint.com within 30 days of first using the App.

General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hatching Point LLC regarding the App.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
• Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
• Survival: Provisions that should reasonably survive termination will remain in effect.
